Pilot participation terms
FoodOrders.ai Kitchen Pilot Program. These draft terms describe what participation involves. They are not a binding agreement and are pending review by qualified counsel.
Kitchen Pilot Program terms — subject to written acceptance. Final pricing, currency, taxes and inclusions are confirmed in writing before any acceptance or payment.
1. What the pilot is
- The FoodOrders.ai Kitchen Pilot Program is a limited, application-based programme of 90 days in which a restaurant location runs FoodOrders.ai in real operation and provides structured feedback.
- Participation is limited and awarded by application. The pilot is open to eligible restaurant locations across the United States and Canada. If places fill, qualified applicants may be placed on a waitlist.
- Each physical location counts as one pilot place, even where several locations belong to the same owner.
- Applying does not guarantee acceptance. Acceptance is a human decision and is confirmed in writing.
2. Participation fee and taxes
- The participation fee is USD $199 per location, plus applicable taxes.
- Applicable taxes are added and administered by the configured payment system. FoodOrders.ai does not provide tax advice.
- No amount is charged when you apply. Any fee is confirmed in writing before it becomes payable.
- A very small number of fee-waived design-partner places may be offered at FoodOrders.ai's discretion for strategically valuable testing.
3. Conversion credit and founding-participant discount
- Participants may select the then-available FoodOrders.ai plan that best fits their operation. No specific plan is guaranteed or reserved.
- Where a participant begins an annual subscription within 30 days of completing the pilot, a one-time credit equal to the participation fee is applied once against the first annual invoice, together with 25% off the first 12 months and no onboarding fee.
- The credit applies to annual billing only. It is not available on monthly billing.
- The credit has no cash value, cannot exceed the invoice it is applied to, is non-refundable, and cannot be transferred to another business.
- The credit excludes hardware, telephone usage, excess-order charges, custom integration work, third-party services, taxes, unless expressly stated in writing.
- No lifetime or permanently locked pricing is offered.
- The pilot never converts to a subscription automatically. A subscription starts only when you explicitly select and accept one.
4. Relationship to the 14-day trial
- The public 14-day trial remains available and is a separate offer with standard public terms.
- The trial and the pilot are not automatically stacked to obtain additional free use. FoodOrders.ai may approve exceptions individually.
5. Restaurant obligations
- Nominate an owner or manager who participates throughout the pilot.
- Attend kickoff and a short weekly review.
- Maintain your existing fallback process for the whole controlled rollout. You will not be asked to remove it, and you may not remove it during controlled validation.
- Complete the scripted simulated orders before enabling live channels.
- Approve your menu snapshot before live orders, and keep menu, pricing and availability accurate.
- Report incidents promptly with enough detail to reproduce them.
- Complete the day-75 evaluation and give an explicit decision.
6. FoodOrders.ai obligations
- Guided setup of menu, hours, modifiers, taxes and fulfillment rules.
- Kitchen screen, notification and audio configuration and testing.
- Printer assessment, agent pairing and documented test evidence where a printer path is in scope.
- A named support contact using the agreed channels and hours.
- Weekly review of check-ins and incidents, and a written day-75 evaluation based on measured results.
- A clean exit: data export, agent unpair, uninstall guidance, and the applicable retention and deletion process.
7. Support and response targets
- Pilot support hours are Monday–Friday, 9:00 a.m.–6:00 p.m. Eastern Time, at pilot@foodorders.ai.
- Ordering or printing unavailable during an active service period: Initial response within 1 hour during support hours.
- Significant but non-blocking issue: Response within 4 business hours.
- General questions and cosmetic issues: Response within 1 business day.
- These are response targets, not resolution guarantees. No 24/7 support and no telephone emergency line is offered.
- Installation appointments and planned testing may be scheduled outside support hours by agreement.
- During service, the required operational fallback is always the FoodOrders Kitchen/Orders screen together with your existing manual process.
8. Scope limitations
- FoodOrders.ai does not replace every POS function, and does not replace accounting, payroll, inventory, cash-drawer or card-terminal management.
- POS and aggregator connectors that have not been implemented, tested and confirmed in writing are described as planned and are not included.
- Printer compatibility is assessed and tested per model and connection. Compatibility is never assumed from a successful install.
- Uninterrupted service is not guaranteed. Telephone usage may be subject to fair-use limits.
- Hardware is not included unless specifically itemised and accepted in writing.
9. Data, privacy and exit
- Restaurant and order data is handled under the FoodOrders.ai privacy notice and the applicable data-processing terms.
- Privacy enquiries: privacy@foodorders.ai.
- Either party may end the pilot in accordance with these terms. On exit, paired agents are revoked, any scheduled billing stops, and the applicable export, retention and deletion process runs.
- A bounded extension of up to 30 days may be offered by mutual written agreement.
10. Governing law
- These pilot terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.
